FOREWARNING

I'm an artist living in a third world country, sadly, power shortages and internet issues are common, which could affect the frequency/time of completion of commission. I am also dealing with mental health issues (depression) that could also affect the process. While this two are not a given in every circumstance, I've decided to give a warning about it.My TOS can be found in multiple places (here,on my site on the invoice I send right before payment) so make sure to read them before paying. Ignorance of the rules does not make you inmune to them and it is not my responsibility if you chose not read them, they still apply to you the moment you pay.


1. GENERAL:

  • I do NOT support NFTs. I will not engage or interact with NFT users and I do not consent for my artwork to be used as an NFT.

  • These terms of service are subject to change, and editing without notice. Please stay up to date with this ToS before purchasing any services.

  • All clients will be screened prior to payment. The artist reserves the right to refuse or refund services with no need of explanations.

  • Rude, abusive, or toxic behaviors (such as harassment, racism, transphobia, pedophilia, zoophilia, etc.), will result in denial of all services, and/or a complete ban from future commissions. IT IS UP TO THE ARTIST TO DETERMINE WHAT KIND OF BEHAVIOUR IS TOXIC BEHAVIOUR, NOT THE CLIENT.

  • If purchasing NSFW, the artist will require proof of legal age, and explicit consent from all owners of the characters involved.

2. PAYMENT:

  • Payment will be taken upfront via a Paypal invoice sent by the artist. All prices are USD.

  • Once a commission has been approved, payment is due within one week. If the commissioner fails to pay within one week, the commission will be cancelled (Unless an arrangement has been done previously).

  • The artist will NOT start work on any commission until payment is confirmed.

  • Partial payments are only permitted when the full price is 100$ or above.

  • In case of partial payments pending, no further progress will be made on the piece until the next payment is completed.

3. REFUNDS:

  • Full refunds will only be given if the commissioner cancels the commission prior to any work being done.

  • Partial refunds will be given according to how much work has been done.

  • NO refunds will be given if the artwork is completed.

  • Refunds require a 3 day notice. Refunds with no notice will incur a 20% fee. Chargebacks on payment with no notice will incur a ban from any future services.

  • If the commission is cancelled during the Concept stage, the artist reserves all rights to the cancelled artwork and may recycle it as they see fit.

  • Multiple consecutive refunds will incur a ban from any future services.

4. ARTISTIC PROCESS:

  • Turn around time (TAT) can be anywhere from 2 days to 3 months depending on complexity/amount of people in the queue.

  • The artist will provide WIPs as the commission progresses via the client’s chosen method of contact. Depending on the type of commission, there are four stages that might be shown as WIPs: Sketch, Lines, Color, and Final.

  • The artist's queue is public here. The page is constantly being update with progress of different pieces on several stages (Paid, approved, sketch/lineart, base color, shading and background).Please refrain from asking for constant updates. If there's any issues pertaining to your artwork in particular, you shall be contacted directly.

  • Do not request me constant updates in a short period of time, it WILL NOT accelerate the process and the only thing you will achieve with it is getting closer to get your commission canceled.

  • Once the commission is finished, you shall be given the full resolution of your image, alongside any other files requested via email.

5. EDITS:

  • Minor edits on the sketch stage are free, 2 major changes (changes on pose/idea) are allowed before requesting payment, 3 minor changes can be made in the lining stage before requesting for payment. Any changes in further stages will require extra payments.

  • A serious diversion from the reference(s) provided (requesting a different color palette, character, pose, etc.), at any stage past sketch will incur a fee.

  • If the artist has been given artistic freedom for a pose, concept or element, only small edits on the sketch will be allowed.

  • If edits are required due to an error on the artist's part (missing scars, small markings, accessories, etc.) they shall be fixed at any stage with no fees. This edits will be withing reason.

  • If there is a major error that was not caught by either party throughout the entire process, the artist is not obligated to change it.

6. ALTERNATE VERIONS:

  • Alternate versions are allowed to be requested at any given stage of the commission. Advanced notice is preferred.

  • Alternate versions are only considered for minor edits (minor accessory change, a different expression, a different eye color, etc.) that do not affect the composition of the piece can be done for free. Depending on the complexity, it could take an extra payment.

  • Alternate versions that involve major edits (pose change that requires major re-lining, re-coloring, re-shading, etc) will be charged as a separate piece altogether.

7. DEADLINES:

  • Deadlines will only be accepted with a minimum of eight weeks in advance.

  • Deadlines are not guaranteed when notified after payment and the artist reserves all rights to refuse them. If you wish to set a deadline after payment, you can pay a rush fee (will vary depending on complexity of the piece and how close the date is).

  • Commissions with deadlines take priority over commissions without deadline, meaning they are attended to firstly regardless of their position in the queue.

8. IMAGE RIGHTS:

  • Any characters depicted will remain under full ownership of their owners, but the copyright of the image itself belongs to the artist.

  • Neither the commissioner nor any other persons may alter, trace, or "finish" the artwork without permission.

  • The commissioner (and any other involved party in the commission) retains the right to use the artwork in any non-commercial way (reposting, icons, wallpapers, headers, etc.) only if proper credit is given.

  • Commissioned artwork may not be used commercially unless it is specifically commissioned with such intent in mind.

  • Original designs created by the artist are not up for redesigning or reworking without the artist's consent.

  • The artist retains the right to display any commissioned work and its stages on any personal gallery and social media, unless informed otherwise by the commissioner.

  • If the commissioner would like the entirety of their commission to be marked private and withheld from being uploaded on social media, it will incur a fee of 50$.
